Thank you for considering Fjaka Sail for your sailing adventure in Croatia.
Before you embark on this exciting journey with us, we ask that you carefully review and agree to the following terms and conditions.
By booking a tour with Fjaka Sail, you acknowledge your understanding and acceptance of these terms:

 

1. Booking And Reservation

1.1. To secure your reservation, an amount must be paid at the time of booking. The specific amount required will be provided during the booking process and stated clearly.

1.2. Your booking is confirmed only upon receipt of the deposit and our formal confirmation notice. If payment is made and you don’t receive a message, check your junk or send us an email at info@fjakasail.com

1.3 Your booking means you agree to all terms and conditions outlined in this document unless explicitly addressed via written email BEFORE your booking is made.

1.4 If you have made a partial payment, your booking is complete and confirmed when the full amount has been paid. Your position is secured with this payment, however, and partial payment is also an agreement to the terms and conditions in this document.

1.5 All bookings are final as of the 31st of March onwards and no refunds will be offered.

 

2. Payments & Payment Plans

2.1. Full payment for your selected tour is due on the 31st of March, and no further payment plans will be allowed from them onwards unless arranged with our team prior. Failure to complete the payment may result in the cancellation of your booking.

2.2. Payments can be made through the methods specified on our website, or if another method is desired please email us at info@fjaksail.com. All transactions are processed in EUR Euros (EU) on our website.

2.3 No two discounts can run in parallel. No two discounts can be used on the same product. No sale item can also be discounted. No payment plan is eligible for a discount (unless communicated and agreed to by Fjaka Sail management).

 

3. Cancellation & Refund Policy

3.1. Cancellations must be submitted in writing to info@fjaksail.com with an explanation of the circumstances

3.2 Fjaka Sail LLC reserves the right to NOT ISSUE ANY refunds from the 31st of March onwards for a tour that is within that calendar year. This includes ANY issue a passenger may have beyond the control of Fjaka Sail.

3.3 By placing your order and booking, you agree to these terms and WILL NOT contest payments after the 31st of March with any payment processing system or your bank.

3.4 Refund tier systems:

Bookings refunds requested after the 31st of March are ineligible for a refund but may be eligible for a travel credit depending on circumstances. However, Fjaka reserves the right to deny any credit or refund under any circumstances after this time, and it is at their sole discretion.

Booking refunds requested from February 1st to March 31st will be eligible for a 75% refund, less any 3rd party fees.

Bookings refunds requested before February 1st will be eligible for a full refund, less any 3rd party fees.

3.5 In the event of extraordinary circumstances, such as natural disasters or government advisories, Fjaka Sail reserves the right to cancel or reschedule tours. You will be provided with a full refund or the option to reschedule in such cases.

3.6 Fjaka Sail reserves the right to cancel and change tour dates. In the event of doing so you will be offered options for your booking such as a refund, change of reservation or credit.

 

4. Travel Insurance

4.1. We require all guests to obtain comprehensive travel insurance that covers trip cancellations, medical emergencies, and other unforeseen events. This is your obligation to ensure you have it before starting your tour with us.

4.2 Fjaka Sail LLC and its team have an agreement with Heymondo Travel Insurance and SafetyWing and through this may offer a discount to passengers with a small affiliate amount recieved to Fjaka Sail in partnership. This insurance is only a product of Heymondo or SafetyWing and not Fjaka Sail and we are not liable for any issues arrising from it, we merely suggested them as an affiliate partners.

 

5. Itinerary Modifications

5.1. Our itineraries are subject to change due to weather conditions, safety concerns, or unforeseen situations. We will strive to offer suitable alternatives in such instances.

 

6. Health And Fitness

6.1. Participation in our tours may involve physical activity. By booking with Fjaka Sail, you confirm that you are in good health and possess the necessary fitness level to engage in the activities. Notify us of any medical conditions that could impact your participation or allergies that may impact the trip.

 

7. Code Of Conduct

Otherwise known as the no D*KHEAD Policy . At Fjaka Sail, we prioritize the safety, enjoyment, and well-being of all our passengers. We have instituted a Code of Conduct Policy, also referred to as the Anti-Discriminatory and Disruptive Behavior Policy.

This policy encompasses, but is not limited to, prohibiting behaviors that are:

– Discriminatory based on race, gender, sexuality, or other protected categories.

– Offensive, aggressive, or disruptive.

– Generally inconsiderate or detrimental to the experience of other passengers.

While we strive for understanding and recognize that mishaps can occur, particularly in relaxed settings, there are actions which are non-negotiable and will prompt a zero-tolerance response.

It should be noted that our staff’s judgment in these matters will be final. If an individual is determined to be in violation of this policy, Fjaka Sail reserves the right to disembark the individual at the nearest main city. In cases involving potential legal violations, we will cooperate with local authorities as required.

Ticket purchasers may be entitled to a partial refund under specific circumstances. However, by purchasing a ticket, passengers acknowledge and agree to abide by this Code of Conduct Policy.

 

8. Liability & Release

While we prioritize your safety, engaging in our tours carries inherent risks. Fjaka Sail and its affiliates will not be held liable for injuries, losses, or damages sustained during the tour. See clause 11. Waiver Of Fjaka Sail And Legal Rights, or if you have any issues please message us before your tour.

 

9. Privacy Policy

9.1. We collect and manage personal information in compliance with our Privacy Policy or that of your region. You consent to our data practices as outlined by using our services.

9.2 We reserve the right to use any photography on any of our social media and marketing channels with your liking included. If you wish not to be published, a written letter must be sent to info@fjakasail.com outlining your reasoning, and it must be BEFORE you attend the tour. Any media taken on the tour by Fjaka Sale LLC is the sole property of Fjaka Sail LLC.

 

10. Governing Law

These terms and conditions are governed by the laws of the state of California, United States.

 

11. Waiver Of Fjaka Sail And Legal Rights

As per the waiver you have been sent and is required before boarding our boat, Fjaka Sail will not be held liable for any actions taken by those on our boat or on land. This is legally binding and covers all 8 sections. If you wish for a copy, please contact Fjaka sail.
